HOW TO ENTER
To enter the Promotion, visit http://www.CWtv.com/Fiesta (the “Web Site”) and follow the on-screen instructions to reach the Promotion registration page that will also feature method-of-entry-related links to Facebook and Twitter. On the applicable registration page and in the spaces provided, supply the following information and entry-related assets:
A participant may enter a maximum of one (1) time per day, regardless of method of entry; however, each Essay submitted must be significantly different in content, presentation and/or messaging (as solely determined by the Sponsor and/or Administering Agency) from any other Essay entered by the same participant. A day, for the purpose of this promotion, begins at 12:00:00 noon and ends at11:59:59 a.m. the following day (unless modified by the Sponsor.) Each Essay that is entered into the Promotion must meet the following “Submission Requirements” (any submission entry that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified). By submitting an entry, you agree that your Essay submitted has not won any previous awards or competitions and shall not contain, include or involve any of the following:
Essays must be in keeping with Sponsor’s image and may not be offensive, as determined by Sponsor at its sole discretion, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. In such an event, the Essay will be disqualified from the contest.
Sponsor and/or Administering Agency has the sole discretion to determine whether an Essay qualifies as an entry. Any entry not in compliance with the above and that does not meet the Sponsor-dictated requirements will be disqualified.
Each participant (or the participant’s Parent if participant is UAOM) agrees to indemnify, defend and hold harmless the Promotion Parties for any breach or alleged breach of any of the foregoing representations and warranties.
All entries must be received no later than Friday, September 3, 2010, at4:59:59 p.m. Entries received before and/or after the Promotion Period will be void. Sponsor will be the official timekeeper for the Promotion.
As a condition of entry, each participant (or the participant’s Parent if participant is UAOM) entering the Promotion must also follow the on-screen instructions to indicate his/her acceptance of these Official Rules. By clicking on the final “Submit” button (in any message or graphic-related representation), each participant forwards his/her entry to the Promotion. If participant is UAOM and does not receive Parent’s consent PRIOR to entering the Promotion, then participant’s entry can be removed from participation at the request of participant’s Parent by the Parent sending an e-mail to FordVampireDiaries@lapromo.com. In the subject field, type “Remove Minor Entry,” and in the message box, provide the e-mail address and full name of the minor who entered.
Nonreadable, garbled or incomplete entries, or participants that do not abide by these Official Rules, as determined by the Sponsor or Administering Agency, at their sole discretion, will be disqualified. All entries become property of the Sponsor and will not be returned or acknowledged. Entries that are submitted by a non-authorized third-party entity on behalf of a participant (or the participant’s Parent if participant is UAOM), including, but not limited to, a Sweepstakes and/or Contest agent or agency, or entries (as determined at the sole discretion of the Sponsor and/or Administering Agency) that are forged, altered or are generated by a macro, bot or other automated means will not be accepted and will be void. Submission of false or misleading information by a participant (or the participant’s Parent if participant is UAOM) will be grounds for disqualification of entry. Proof of submission of an entry will not be deemed proof of receipt of an entry by the Sponsor or the Administering Agency. For purposes of this Promotion, an entry is “received” online when The CW’s or designated agent’s Web Site servers record the entry information upon participant clicking the final “Submit” button (in any message or graphic-related representation). Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Promotion. All entries must be submitted legitimately.
In the event of a dispute regarding the identity of a participant, the entry will be deemed submitted by the authorized account holder of the e-mail address provided, but only if that person meets all other eligibility criteria. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain name associated with the submitted e-mail address. Potential winner may be requested to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the potentially winning entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible.
WINNER SELECTION/JUDGING CRITERIA:
The Sponsor and/or their designated representative(s) (“Judges”) will rank each entry based on a scale of one (1) to ten (10) [ten (10) being the best] for each of the following categories: 1) ESSAY CREATIVITY, i.e., how (creatively) the submitted Essay communicates why the participant is the biggest fan of the Series; 2) UNIQUENESS OF ESSAY SUBJECT MATTER, i.e., how uniquely the description of the participant’s fandom of the Series is presented; and 3) AUDIENCE APPEAL, i.e., at the sole discretion of the Judges, will the participant’s (from a programming content standpoint) be appealing for Series viewers to read.
Subject to the tiebreaker rules set forth below, the entry with the top cumulative score will be deemed the Grand Prize winner (subject to eligibility verification).
In event of a tie, the tie will be broken by selecting the tied Participant with the highest score in the ESSAY CREATIVITY category. If a tie still remains, the tie will be broken by selecting the tied Participant with the highest score in the UNIQUENESS OF ESSAY SUBJECT MATTER category and then, if necessary, in the AUDIENCE APPEAL category. This judging rationale will be utilized and repeated to rejudge the tied entrants, as necessary, until a Grand Prize winner is determined.
Decisions of Judges/Sponsor are final and binding in all respects and are nonappealable. If a tentative prizewinner is found ineligible or fails to comply with these Official Rules, that person’s prize may be forfeited and an alternate entry may be selected based on the next highest score.
One (1) Grand Prize will be awarded: The Grand Prize winner will receive a 2011 Ford Fiesta SES Hatch, decorated in a Vampire Diaries– themed decorative vinyl wrap (hereinafter referred to as the “Decoration”). ARV of Grand Prize: $18,885.00. (Final MSRP of vehicle awarded based on, but not limited to, vehicle model, accessories and winner’s city of residence.) Design, content and execution of the Decoration are at the sole discretion of the Sponsor.
Grand Prize winner may be required to provide his/her valid state-issued driver's license and Social Security number and to comply with any other legal or dealership requirements before being able to take possession of the prize (see Grand Prize Winner Notification Process paragraph below for complete disclosure).
Grand Prize winner will be issued an Internal Revenue Service form 1099 for the Grand Prize based on the actual ARV.
Actual Grand Prize vehicle awarded—model, year, color and accessories and the Decoration—may vary from that depicted in the advertising and promotional materials and is at the sole discretion of the Sponsor and subject to availability from manufacturer. Grand Prize winner must take delivery of the vehicle from a Ford dealership or authorized representative (“Representative”) near the winner’s home as designated by the Sponsor, Ford and/or the Administering Agency.
Grand Prize does not include transportation to and from Grand Prize winner’s residence and the dealer providing the vehicle and/or any other expenses not specified in these Official Rules (except as indicated in the “Additional Prize Information/Taxes” section). All of the expenses mentioned in the previous sentence are the sole responsibility of the Grand Prize winner.
Grand Prize winner must abide by, and is subject to, any and all minimum/maximum height, weight and health-related requirements or restrictions that may affect accessibility to and/or use of the prize.
Any additional amenities awarded, other than those specifically disclosed in these rules, will be awarded at the sole discretion of the Sponsor.
Promotion Parties are not responsible for and winner will not receive the difference between the actual value of the prize at the time of award and the stated ARV in these Official Rules.
No more than the prize stated will be awarded.
By entering this Promotion and accepting the Grand Prize, the Grand Prize winner (and, if Grand Prize winner is UAOM, his/her Parent) agrees to maintain his/her behavior in accordance with all applicable laws and generally accepted social practices in connection with participation in any Promotion- or prize acceptance–related activity. By entering this Promotion and accepting the Grand Prize, Grand Prize winner (and, if Grand Prize winner is UAOM, his/her Parent) agrees that Sponsor, Ford, their designated representatives and/or the Administering Agency reserve the right at their sole discretion to disqualify and remove the Grand Prize winner (and/or, if Grand Prize winner is UAOM, his/her Parent) from any activity at any time if the Grand Prize winner’s (and/or, if Grand Prize winner is UAOM, his/her Parent’s) behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property or the reputation of any of the Promotion Parties or otherwise violates the policies of the Promotion Parties.
GRAND PRIZE WINNER NOTIFICATION PROCESS:
On or about Saturday, September 4, 2010, the potential Grand Prize winner (or, if potential Grand Prize winner is UAOM, his/her Parent) will be notified by telephone and/or e-mail that he/she may be the winner in this Promotion, using the contact information provided in his/her entry. If the potential Grand Prize winner (or, if potential Grand Prize winner is UAOM, his/her Parent) cannot be reached after a reasonable effort (as determined solely by the Administering Agency) has been made, such person may be disqualified and an alternate entry may be randomly selected from all eligible entries received.
Once Administering Agency has received verbal confirmation from the potential Grand Prize winner (or, if potential Grand Prize winner is UAOM, his/her Parent) of his or her desire to accept the Grand Prize (subject to verification of eligibility), potential Grand Prize winner will receive a Grand Prize Winner Affidavit of Eligibility/Release of Liability and Travel Companion Release of Liability Affidavit (“Affidavits”) via e-mail, mail or other courier service. The Grand Prize winner must complete the Affidavit, or if the Grand Prize winner is UAOM, then the Parent of that individual must complete the Affidavit for him/her and must complete the Parent section of the Affidavit.
The Affidavits must be completed, notarized and returned to the Administering Agency (L.A. Promo, 302 Fairview Road, Suite P, Ojai, CA 93023) within forty-eight (48) hours of the date/time the Administering Agency sent the Affidavits. A disqualification may result and an alternate entry may be randomly selected from all eligible entries received if all Affidavits are not returned to the Administering Agency within the specified time.
ADDITIONAL PRIZE INFORMATION/TAXES:
There is no substitution for the Grand Prize or any portion thereof, except due to unavailability, in which case a prize of equal or greater value will be awarded at the sole discretion of the Administering Agency and/or Sponsor. The Grand Prize is not transferable, assignable or redeemable for cash, except at the Sponsor’s sole discretion. All federal, state and local taxes (including, without limitation, any excise tax, sales tax and EPA tax or fee), as well as automobile insurance and all registration, title, dealer preparation, applicable destination charges, license, any upgrade or option packages, additional equipment and other expenses not specified herein, are the sole responsibility of the winner.
Grand Prize winner will be required to take delivery of the Grand Prize vehicle from a designated Ford dealership or Representative within thirty (30) calendar days of Grand Prize winner’s notification of vehicle availability. If the Grand Prize vehicle is not picked up within the thirty (30) calendar days, the Grand Prize winner shall automatically forfeit the Grand Prize vehicle and an alternate entry will be selected. If Grand Prize winner’s residence is outside a distance of seventy (70) miles of the designated Ford dealership or Representative, Sponsor may provide the Grand Prize winner with either a transportation allowance or transportation to the designated Ford dealership or Representative. Transportation fee or transportation to the designated Ford dealership or Representative is at Sponsor’s sole discretion. All other travel and transportation costs associated with collecting the Grand Prize vehicle from the designated Ford dealership or Representative are the sole responsibility of the Grand Prize winner.
By accepting the prize, the Grand Prize winner (and, if Grand Prize winner is UAOM, his/her Parent) agrees that Sponsor may, at its option, conduct a background check on the Grand Prize winner. If necessary or requested, the Grand Prize winner (and, if Grand Prize winner is UAOM, his/her Parent) agrees to sign waiver forms authorizing the release of personal and background information.
